Terms of sale and licence, azokroma Patterns

1. Seller

azokroma, SASU (single-shareholder simplified joint-stock company), 4 Les Bouygues, Roquecelier, 15130 Yolet, France. Contact: hello@azokroma.com.

2. What you buy

A repeating digital pattern, composed by you on the Patterns page and delivered as files (SVG, and PNG or JPG generated on request). Offers: Pattern, from $3 excl. VAT ($3.60 incl. VAT), one pattern in the chosen colours; Pattern + colourways, from $8 excl. VAT ($9.60 incl. VAT), the same pattern in free colours; Collection, from $17 excl. VAT ($20.40 incl. VAT), three matching patterns in free colours; Exclusive assignment, from $65 excl. VAT ($78.00 incl. VAT), the collection with assignment of rights and a certificate.

3. Prices and payment

Prices are in US dollars and depend on the number of motifs in the tile: each offer includes 4 motifs, then a supplement for each extra motif ($1, $1, $1 or $1 excl. VAT depending on the offer) up to 16 counted motifs. The exact price is shown before payment. VAT at 20% is added at payment. Payment is by card, on Stripe’s secure page. An invoice is sent by email. While you pay, the composition is held for you for about 30 minutes.

4. Exclusivity

A composition is defined by the chosen motifs, their number, the layout, the spacing, the size and the pattern number, whatever the colours. Once sold, it cannot be sold to anyone else, in any colour. The drawings that make it up (fruit, flowers, animals, dots, shapes) remain the property of azokroma and may appear in other compositions.

5. Licence

For the Pattern, Pattern + colourways and Collection offers, azokroma grants you, for the composition you bought, a worldwide, perpetual, personal, non-transferable licence for any use, including commercial:

• printing on finished products (textiles, stationery, packaging, decoration, objects) and selling them, with no limit on quantity;
• online and offline use (websites, social media, presentations, communication materials);
• modifying the files to adapt them to your products.

The following are forbidden: reselling, sharing or distributing the files themselves (alone or in a pack, template or library), registering the composition or any of its elements as a trademark, and suggesting that the base drawings belong to you.

For the Exclusive assignment offer, azokroma also assigns to you the economic rights it holds in the composition you bought (reproduction, representation, adaptation), worldwide and for the legal term of protection. The assignment covers the composition, not the base drawings taken separately.

6. Delivery and withdrawal

The files are available as soon as payment is confirmed, on a personal page whose link is in the receipt. Business customers: no right of withdrawal applies. Consumers: under Article L. 221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for digital content not supplied on a physical medium whose performance has begun with the consumer’s prior express consent and express waiver of that right; by asking for immediate access to the files when you order, you waive your right of withdrawal.

7. Faulty file and refund

If a file is unusable, write to us: we will fix it or refund you. If two buyers pay for the same composition at the same time, the second one is refunded automatically.

8. Personal data

Your name, email and billing details are used to process the order, deliver it and keep the accounts. See the privacy policy.

9. Governing law

French law. For disputes with a business: Judicial Court (Tribunal judiciaire) of Aurillac, commercial division.
